UMANA SLUMPS AS PLOT TO RETIRE CJN IN VIEW OF AKWA IBOM'S JUDGEMENT BEGINS

When the Supreme Court in a panel of 7 justices declared Chief Barr. Nyesom Wike Governor yesterday it broke the hearts of so many people. In fact, all the people in the politico-concentration camp called APC were suddenly despaired. Most devastating of all are those who left Wike's Victory camp barely two weeks ago to join Amaechi's Utopian Calvary. Their grieve was that Gov. Wike had share all the juicy appointments without giving them. This treachery turns out to be very effective against them. It's what the parasite, selfishness, does to its host. Today they are neither comfortable in APC nor welcome in Wike's PDP. They are in what I believe the famous Language and Political Theorist Dante Alighieri would agree with me to be "Political Purgatory"- utterly stranded in uselessness as far as politics is concern. A summary dismissal without the benefit of political pension! And the next four years is going to be a tenebrific experience for them. It is earnestly unimaginable what a man like Gov. Wike can achieve in four years of being totally in charge in Rivers State.
Interestingly, the ripple effect of this like that August 9th 1945 bombing of   Hiroshima in Nagasaki is a palpable apprehension in not far away Akwa Ibom State. Those who left PDP in the state to join the APC are beginning to reconsider their steps and review their decision. The leader of that camp Obong Umana Okon Umana is beginning to develop Politically inflicted Parkinson condition. Word on the street is that he slumped yesterday when the news reached him. It is gathered that he subsequently made efforts to reach Amaechi who has not really been his good friend lately to explain what was happening. And trust the people to propaganda; they have already started considering retiring the Chief Judge of the Federation whom they suspect to have some sort of soft spot for PDP being the party that appointed him CJN at such old age in the first place.
Suddenly, Hon. Justice Mahmud Mohammed is too old to be Chief Judge of Nigeria but Maj. Gen. Muhammadu Buhari is not too old to be president of Nigeria. This aspersion is coming from Amaechi's wing of the APC who are beginning to also suspect that in four years they would have outlived their usefulness and Wike may likely be Buhari's most sought after in South South should President Buhari renege on his single term agreement to seek a second term. At that point somebody like Rotimi Amaechi would have become a political vegetable in Rivers State bereft of any bargaining power in the system.
Now, as we approach the catharsis of this epic political drama come February 15 when the Supreme Court rules on Akwa Ibom State Gubernatorial polls there is no gainsaying that the hand writing on the wall is clear! Who would have thought that the APC did not have the whole of the judiciary in their pockets following the way they have been influencing some critical political judgments to the obloquy of the nation? Thankfully the narrative is changing by what literature professionals would term "Deus Ex Machina" denoting the Act of God. In weeks we shall see if this God shall extend his work to Akwa Ibom state. Meanwhile, it is imperative to recall here that it was Gov. Udom Emmanuel who first hinted of this divine and wondrous machinations when he openly exhorted the people of Akwa Ibom after the Court of Appeal's controversial judgment in the following words: “Our God is not a God of Appeal but the Supreme God and so we will follow the Supreme God to the Supreme Court.”

SUPREME COURT CONFIRMS WIKE GOVERNOR

The Supreme Court will today start hearing on the appeal brought by Governor Nyesom Wike of Rivers State challenging the judgment of the Court of Appeal which upheld the nullification of his election by the Election Petition Tribunal.

The Supreme Court has upheld the outcome of the April 11 governorship election that ‎brought Governor Nyesom Wike of Rivers State to power.

The apex court in an unanimous judgment, restored the declaration of Wike as the valid winner of the poll by the Independent National Electoral Commission, INEC.

Justice Kekere-Ekun who delivered the lead verdict, held that three separate appeals that were filed by Wike, PDP and INEC, were meritorious.
Wike had filed 20 grounds of appeal to the Supreme Court, alleging that the election tribunal, high court and appellate court relied on hearsay and legally inadmissible evidence to arrive at its judgment as well as violated his constitutional right of fair hearing.
The Aluta Governor asked the Supreme Court to hold that the lower courts wrongly refused to follow the decision in Agbaje versus Ambode’s case, which stated that the use or non-use of Card Reader cannot be a ground for questioning or nullifying an election.
He also urged the apex court to hold that the findings and conclusions of the lower court are perverse and not supported by any legally admissible evidence on record.
Apropos, concurrent judgments of both the Rivers State Governorship Election ‎Petition Tribunal and that of the Abuja Division of the Court of Appeal were all set aside by the Supreme Court.
The apex court panel headed by the Chief Justice of Nigeria, Justice Mahmud Mohammed however reserved their reasons for the judgement till February 12.

Now for those of us who have been claiming how Buhari's administration is masses oriented it is only fair that we all are following the budget debate at the NASS if we aren't scrutinizing it ourself bearing in mind how we all castigated the previous administration over spending. Be that as it may, let yours faithfully, Watchout Naija guide you through the tenebrific nooks and crannies of our 2016 budget of betrayal.

1. Buhari increased the budget for presidency's upkeep from  N6.6b in 2015 to N18b.

2. Buhari raised the Villa Menu from N542m in 2015 budget to N1.75b.

3. Buhari lampooned NASS over N4.7b budget for cars but budget for the presidency N3.6b for BMW Saloon cars. Now presidency and NASS where do we have more people?

4. Buhari budgets N3.6b for maintenance of presidential jets rather than selling most of the jets as promised during campaign in fact between June and November 2015 the presidency through Shehu Garba admitted spending the whooping sum of N2.8b on the maintenance of these fleets.

5. Buhari budgets N764m for presidential recreational facility.

6. Buhari instead of voting more money for agriculture and solid minerals in the face of fast declining oil revenues has N39.1b for ministry of information and N29b for agriculture which means "MORE PROPAGANDA, LESS FOOD FOR THE MASSES!"

7. Buhari budgets N400 million on a weekend symposium - the 35th Annual General Meeting and Symposium of Shelter Afrique slated for June 2016! Where are the people yelling against wastage and corruption last year?

8 Buhari budgets N13.7b for Ministry of Transportation N13.7, N7.2b Ministry of Water Resources and N10.5b Ministry of Industry, Trade and Investment. Add the allocation for these three vital masses oriented ministries together and it is still less than Lai Muhammed's N39.1b

9. Buhari budget N45b for INEC in a year when there is no national election. What for?

10. Buhari budgets N294.5b for the Ministry of Defence, N145.2b for The Ministry of Interior, N283.09b for the Nigeria Police Formation and Command, then N10b for “Operation Lafiya Dole” which means “Compulsory Peace” or “Peace by Force" in Hausa. Altogether it gives you N732.79b. Why all this duplicity in the name of security?

11. Buhari who promised to create employment for Nigerian youths has budgeted only N7.8b for the Ministry of Labour and Employment, N9.5b for the Ministry of Mines and Steel Development, N25.8b for Science and Technology Ministry. Add these to transport and water resources ministries and you'll get N64b for the five most important masses impact ministries. This is less than the N72.8b Buhari has allocated to his Minister of Special Duties: What are the Special Duties to be done that they should cost so much?

12. Buhari budgets N45.3b for the Office of the SGF and N6.4b for Office of the Head of Service. To do what please?

13. Buhari's budgets N2.9b for an abstract and idle thing as Federal Character Commission.

Personally, I don't smell any rat in the likes of misapplication of funds here. I'm just wondering why Former President Goodluck Jonathan was practically crucified for budgeting N1billion in 2011 which he reduced to N717.3 million in 2013 yet the criticism continued, then he went down to N542 million in 2014 still we weren't placated and in 2015 he made it N530m but we said it was still too much spending.
And now it's not just too much spending but the borrowing too. I'm sure we aren't complaining because THIS IS CHANGE!

While most people barely frowned at the recent critical legal submissions by Sen. Ita Enang regarding the present political developments in Akwa Ibom state as unguarded and misleading an Abuja based lawyer has taken steps beyond just frowning by suing for the prosecution of the distinguished former law maker. Barr. Okpo Ewa who is a vibrant legal activist has before now expressed his disagreements with the former law maker on articles, broadcast interviews and public hearings wrote to the Attorney General and Commissioner for Justice asking for fiat to prosecute the senator as a private prosecutor or in the alternative the A.G should prosecute the accused himself. According to the lawyer the former law maker turned presidential aide has made inciting comments against the state government which if not well managed can cause serious crisis in the state and civil disobedience.
The letter was received and acknowledged by the Ministry of Justice on Tuesday 12th January 2016 to send feed back by Thursday 14th January 2016.
"People should know that there are limits to criticisms, mediocrity and shenanigans. There are legal and moral boundaries to everything we do or say. So for a lawyer whose call peers are Senior Advocates of Nigeria (SAN), Justices of Court of Appeal and Supreme Court and who is also a veteran law maker to wake up and tell the public that there is no Governor in a state when there is pending litigation on the election of the governor is very wrong. There are states in Nigeria that can burn if you say something like that. The last time we had opposition leaders malign the the state government like this was in 2011 and the violence that followed eventually is still fresh in our memory. Something has to be done to bring order to such civic recklessness even if it would take making a scapegoat out of suppose sacred cow. I'm very ready to run this cause and should the A.G fail in his duties then some of us I'm afraid may have to sue for his relief." He said.

ANOTHER VERSION OF OLIVER TWIST!

The New Oliver Twist

Don't be afraid to ask. I wish I could say that a million times. Many people are just living low level lives because they were afraid to ask for more.

Recently, I had a conversation with someone. That conversation actually inspired this note. She told me she wanted to participate in a Pay What You Want session of SPL that I held some time ago but she could not raise the money she had proposed to pay. So she did not participate.

The irony of it was that in that same session there was one other person who participated in that class, taking advantage of the "Pay What You Want" offer. But this other person paid AFTER the class. What was the difference? He asked.

He inquired from me if he could participate and pay after the class and he gave me his reasons. Now, that does not mean I say yes to everyone who tries to do that but I have said yes to a few. What if they did not ask at all?

The worst that will happen when you ask is that you will get a "No" for an answer. But nobody ever died because they got a "No." Some people have even gotten a "No" when they asked the question, "Will you marry me?" in front of an audience that had been pre-informed to celebrate with them hoping she will say "Yes." It does not get "badder" than that.

Truth be told, and sales people are trained on this, you will get a lot of "Nos" before getting one "Yes." That is an undeniable fact. So the earlier you start getting your "Nos" the better for you. It means you are getting closer to your "Yes."

Not everyone driving a big car paid cash for the car. Not everyone in Harvard paid the actual tuition. The difference is that they were bold enough to ask. You can get a good car in Nigeria with a 20percent down payment. You may not believe it but it is true. You can go to Harvard on scholarship. But you will never know until you ask.

Am I saying that you should therefore be looking for ways to get everything without paying for it? No. But there are times an opportunity will come and you don't really have the financial power to take a hold of it. That should not stop you.

You missed the class when it was N5,000 because you did not take it seriously. That very class now costs N15,000 to register for it. Why don't you do everything to participate NOW instead of regretting missing it when it was N5,000. One day it will be N150,000. What will you do then?

It depends on how much value you place on that class. You can meet the organisers and plead for a discount. You can plead that they let you participate and you pay later. You can borrow the money from a friend so you can attend the class and you pay back the money on a later date. There are a million options to try. It depends on how much value you place on the class. The worst you will get is a "No."

Be the new Oliver Twist. Don't be afraid to ask.

LAWYER CALLS FOR SEN. ITA ENANG'S ARREST FOR TREASON AND OTHER CHARGES

Why some of us found it difficult to congratulate the learned Sen. Ita Enang on his appointment as the Senior Special Assistant to President Muhammadu Buhari on National Assembly matters (Senate) was because to us it was just a sign of many unfortunate things to come. This is because it is difficult to discern how such an intelligent lawyer and law maker would survive amongst the crooks in this country that now go by the name All Progressives Congress (APC). And this fears of ours like Job's in the bible finally came upon us from the very moment the learned and erstwhile law maker resumed his duties. First it was the ministerial nomination list saga where he cajoled Nigerians to believe that the president had given the list to him in New York as it is traditionally the duty of his office to convey it to the National Assembly when indeed the president never trusted him enough to discharge such responsibility. But Our beloved senator is a man of wits and good con, so he passed. Then came the judgement of the Akwa Ibom State Governorship Electoral Tribunal sitting in Abuja where elections in 18 out of 31 local government areas in Akwa Ibom state were nullified. The distinguished senator surprisingly went on air to declare that Akwa Ibom state was without a Governor by virtue of that judgment! By such junk jurisprudence he stirred all sorts of confusion in the minds of the good people of Akwa Ibom state. Such a statement if made in some more volatile states is ordinarily capable of inciting unquenchable unrest and possibly sedition or treason attempts against the state. Telling a people that they do not have a governor when their government house is not vacant is not an affordable ruse. It is something people in some parts of this country would not take likely. It is a statement some volatile masses will take seriously with serious actions. It is more than enough clarion call for civil disobedience. After all, the last time a group of young political fanatics attacked a sitting governor in Akwa Ibom state was in 2011 and it was on some relatively far less inciting political notions.
As if that was not enough, by the time the Court of Appeal against extant precedent wisdom decided to order a re-run of the Akwa Ibom state governorship elections in all 31 local governments coupled with a subsequent nullification of the election of Elder. Aniekan Uko who was the speaker of the house our very ingenious senator went on air again to tell the public that the import and purport of the court's judgement was that Akwa Ibom state was without a legitimate governor and a substantive speaker therefore the chief judge should be sworn in as Governor in the absence of both forgetting that the court of appeal was not the final authority on the validity of election of state governors but Supreme Court meaning the governor still had the option of appeal to the Supreme Court to exercise. Interestingly, as a practicing lawyer, a judgement cannot be enforced on the day of judgement nor once a notice of appeal has been given. And in fact, mere oral statement of intention to test the judgment in appellate jurisdiction suffices to stay execution. In addition, there is a statutory three months window for appeal which only begins to run from the day the appellant receives notice of the decision he is complaining against. Every practicing legal practitioner and studious lawyer knows this. Perhaps the judicial authority of Aladegbami v Fasanmade (1988) 3 NWLR PT. 81, p. 129 would be helpful for those who are not so conversant with law and practice.
Unfortunately, these recent broadcasts by the learned presidential aide has not gone unnoticed. On the contrary, it has succeeded in brainwashing the gullible and confusing the less gullible such that some of us have had the burden of explaining to law students and unlearned citizens who approach us for further clarification that the Senator is merely venting jurisprudence of sentiments and not legal jurisprudence. Call it "Enang-prudence" if you like. But this is only for those who have the privilege of better counsel. The truth is, these statements by the former law maker are criminal incitements that should not be taken lightly. To tell a people that they do not have a Governor when a legitimate substantive Governor is on seat is to tell them or a section that cares to listen to unseat their Governor. It is seditious! It is treasonable! Patriots have been hanged in the past for lesser indiscretions let alone such maliciously and mischievously calculated seditious shenanigans!
But, since Akwa Ibom state is lead by a man whose genteel nature and orientation makes him think that taking certain decisive actions is coterminous with being desperate for power such attempted treasons seem to escape caution.
The problem with such situations is that they get worse. They breed more and continue to thrive until they hit their mark if they are not called to order. That is why the distinguished senator had the effrontery to go on air recently again to accuse the governor of initiating Akwa Ibom youths into cults in the name of empowerment programmes. And some ire youths have started picking on him through the social media. Only God knows what this could generate to if not properly managed. Such insinuations or suggestions should not come from a lawyer let alone one who has been a carrier law maker. This is a criminal defamation of the person and office of the governor and should not be condoned for any reason whatsoever. What a reasonable man would ask here is whether a man of straw would have gone free for saying such things against the state? Would any one walk freely in Nigeria for expressing such allegations against the president of Nigeria whom the distinguish senator works for?
Albeit, it cannot be over emphasized here that the senator works for a Federal Government that is presently violating the rights of a freedom advocate against court orders when the cause the young man is advocating for has long been recognized for consideration at the United Nations where Nigeria is a member. Does the senator not represent a Federal Government that is presently sponsoring a bill to truncate freedom of speech in this country all in the name of seeking to regulate criticisms of government while he makes it his new stock in trade to render contumelies against his own state government, disregarding constituted authority in his very own state and inciting the masses against same?
To call a spade a spade in modest terms, it is unfair what the learned emeritus legislator is doing to himself and his state in the name of politics. Not one single adumbrated position of the senator since he resumed league with his new gangs has been legally, jurisprudentially or morally sound. Meanwhile, it is impossible to forget that this is a man who has never really contested an election in his entire life in the real sense of "contest" because he is always being used to settle some political face offs or some powers from above have anointed him or zoning favors him there by earning the name "Udoh Nfoniso" meaning "Lucky Son." But what do we have today? With pomp and pageantry, he is talking from the other side of his mouth. Imagine what damage politics can do to a desperate man no matter how learned he may seem. Truly a misguided mind can achieve more damage with truth twisted than the devil can achieve with lies.
Thus, from the foregoing, without prejudice to distinguished Sen. Ita Enang, the Attorney General of Akwa Ibom State should arrest and charge the senator for making seditious statements against the government of Akwa Ibom state, inciting treasonable felony against the state of Akwa Ibom state and criminally defaming the person and office of the governor of the state. This is a passionate plea from a fellow minister in the temple of justice. Immunity of the president does not cover the president's man nor family.

EFCC ARREST OBASANJO & TINUBU?

EFCC Arrest Obasanjo, Tinubu, both to face trial on Monday.
It was a mild drama at Muritala Mohammed International Airport today around 2:30pm Nigeria time when DSS and EFCC officers arrest former president Olusegun Obasanjo on his way out of the country.
The former president who was said to wear a white Agbada with a black shoe was arrested by DSS with Hand cuff in his hand the moment he arrived at the airport this afternoon.
As at time of filling this report, former Governor of Lagos state Asiwaju Bola Ahmed Tinubu was also said to have been arrested by DSS at his residence no 26, Bourdilion road, Ikoyi Lagos.
The main reason for the arrest of these two prominent politician is yet to be Known but our source has it that EFCC and ICPC has sent different letters of invitation to former president Olusegun Obasanjo and Tinubu due to different sorts of allegations which was leveled against them but they refused to yield to their request.
Former president Olusegun Obasanjo was said to have being involved in Harlibuton bribery case and according to the on going Investigation by the National assembly on power sector, an underground source has it that the former president was said to have embezzled 570billion naira which was budgeted for the power sector from 2005-2007.
According to our conversation with one of the EFCC officer who refused to reveal his name, he stated that Tinubu was said to have embelzzled 63billion from 1999-2007 when he was the former Governor of Lagos state.
According to the source,Tinubu, his wife and his Lawyer are presently at EFCC headquarters in Abuja and the interrogation has commenced immediately.
The arrest of the two prominent politician is due to president Muhammadu Buhari's Zero tolerance to corruption and his determinations to fight corruption not minding whose ox is gored.
